Your privacy is very important to Yoga Under the Palms, LLC (“Yoga Under the Palms,” “we,” “us,” and “our”). We also understand that privacy is very important to you. This Privacy Notice describes how we collect, protect, and use any information we collect from or about our students, ecommerce customers, Yoga On Demand users, and website visitors, and your ability to control certain uses of it. It does not apply to employees or job applicants. Within this Privacy Notice, we refer to attending a Yoga Under the Palms class or event (live, online, or recorded), visiting our website, making a purchase on our ecommerce site, or otherwise interacting with Yoga Under the Palms collectively as engaging in Yoga Under the Palms “Activities.”

This Notice applies to the information we collect from or about you when you participate in Activities, or otherwise interact with us. It does not apply to information we collect from employees or job applicants of Yoga Under the Palms. This includes information such as, for example, your name, address and device information that can reasonably be linked to you or your household, such as your IP address. By participating in the Activities, you are consenting to the collection, use, disclosure, and transfer of your information as described in this Notice. INFORMATION WE COLLECT

We collect information from you when you provide it to us, from third party sources, including social media platforms, and from you automatically when you participate in the Activities.

Information You Provide.

Yoga Under the Palms collects information you provide to us when you participate in the Activities. For example, we collect the information you provide when you create an account, complete a questionnaire, communicate with us, sign up for or attend an event, take a class in person or through our Yoga On Demand platform, view a recording through our Yoga on Demand Vimeo platform, purchase products from our website www.yogaunderthepalms.com fill out a webform or otherwise interact with this us. The personal information we collect from you directly when you provide it to us, when you interact with us, or when you visit our Site, may include the following:

Contact information, including your name and/or nickname, email address, mailing or delivery address and phone number

Order information, including the products you purchase or services you request from us, and your shopping behavior and preferences

Payment information, including billing address and payment method, in order to facilitate payments to us and keep a record of payments we receive. Payments are processed by our third-party payment processor, and we do not collect credit card or financial account information from you

Sensory information through our on-premises surveillance cameras used in the retail area and front-desk area of our studios

Credential information for eCommerce customers who create an account within Shopify, including your username and password

Information about your interests, such as your buying habits based on previous purchases

Information about your preferences, such as whether you prefer teacher assists in class, or prefer to not have teacher assists

Your correspondence with us, if you reach out to us for customer service or technical support, or apply for Yoga Under the Palms’s BIPOC scholarship

Information about your race, ethnicity or other characteristic that you choose to share with us as part of our BIPOC scholarship, if you apply for the scholarship

Any other information you voluntarily provide to us, including information about any health or medical conditions you may have that you disclose to us as part of your yoga practice or when you are freezing or canceling your membership

Information We Collect from Third-Party Sources, Including Social Media Platforms.

We may collect information about you from third party sources. This includes third party booking platforms that you book a Yoga Under the Palms class through, such as Airbnb experiences, Active & Fit and OnePass, which provide us with your name, contact information, and any applicable consent form you sign when you agree to take one of our classes. By doing this, you are giving permission for the third-party platform to send us information and for us to collect that information from them, including personal information from your profile on that platform such as your name, email address, and social media user ID, among other information.

INFORMATION DISCLOSURE

Yoga Under the Palms may disclose the information we collect from and about you as follows:

To Yoga Under the Palms Employees, Teachers and Guest Instructors, Event facilitators and tenants of our studios. The information we collect from you will be disclosed or accessible to Yoga Under the Palms employees, including instructors of our classes, studio employees and corporate employees.

With Third Party Partners. We may share your information with other organizations who partner with Yoga Under the Palms on certain initiatives. For example, from time to time, we partner with other health or wellness initiatives to co-facilitate an event. At these co-facilitated events, your information may be shared with all sponsors. We may also partner with third parties to sponsor contests or other promotions, and we may share with these third parties the information you submit to us to participate in the contest or take advantage of the promotion.

To Third Parties for Our Marketing Purposes. We disclose information to third parties who assist us in our marketing efforts by developing target audience creation tools based on information we provide to them about our existing target customers.

To Third Parties for Our Text Program Purposes. If you sign up for our Text Program, we may disclose your Text Program opt-in or consent status with third parties that help us provide our Text Program services, including, but not limited to platform providers, phone companies, and our service providers who assist us in the delivery of text messages. We do not disclose your Text Program opt-in or consent status for purposes unrelated to providing you with the Text Program services.

As Part of a Business Transfer. Your information may be transferred to successor organization if, for example, we transfer the ownership or operation of the Activities we offer to another organization, if we merge with another organization, or if we liquidate our assets and sell them individually. If such a transfer occurs, we will endeavor to ensure the successor organization’s use of your information will still be subject to this Notice and the privacy preferences you have expressed to us.

To Comply with Laws and Protect Our Rights and the Rights of Others. We may disclose your information when we, in good faith, believe disclosure is appropriate to comply with the law, a court order or a subpoena. INFORMATION RETENTION

Yoga Under the Palms retains the personal information collected on this Site as long as necessary to provide the services, products and information you request or as permitted by applicable law.

A NOTE ABOUT CHILDREN’S PRIVACY

You must be at least 13 years old to have our permission to use our website, mobile app, or online service offerings. We do not knowingly collect, use or disclose personal information about visitors under 13 years of age. INFORMATION PROCESSING IN THE UNITED STATES

Yoga Under the Palms is a U.S. corporation. The servers that support this Site are located in the United States. While it is in our possession, your information will generally be stored in Yoga Under the Palms databases or databases maintained by our third-party service providers on servers and data storage devices located in the United States. U.S. data protection laws may not provide as much protection as the data protection laws in force in some other countries, however, we will process your information in accordance with this Policy no matter where our data is stored. If you are located in a country outside the United States, by using this Site you consent to the transfer of your information to the United States.

EGIFTS AND REFERRALS

If you choose to use or send electronic gift cards, or referrals to third parties, you must first obtain their permission to provide their personal information, such as their name, phone number or email address, to Yoga Under the Palms. The referred information will be used by Yoga Under the Palms for the purpose of contacting the third party recipient, on your behalf, to deliver the gift card or referral via email.

GOVERNING LAW

This Policy shall be governed under the laws of the State of Colorado in the United States of America without regard to its conflicts of law provisions.

Disclosures of Personal information for a Business Purpose

Right to Request Access or Right to Know

After we receive and verify your request, we will delete (and direct any of our service providers that hold your personal information on our behalf to delete) your personal information from our records, unless an exception applies. You have the right to opt-out of the sale or sharing of your personal information. We believe we only use your Sensitive Personal Information in ways that you would reasonably expect are necessary to perform the services or to provide you with the goods you request. Yoga Under the Palms does not “sell” or “share,” as those terms are defined, Sensitive Personal Information.

Right to Correct Personal Information if the Information is Inaccurate

If you believe or discover that any personal information that we have collected about you is inaccurate, you may contact us to request that we correct and update the information so that it is accurate.

Right to Appeal (Colorado Residents)

Residents of Colorado are entitled to file an appeal should their request to exercise any of the above rights be denied. Requests for appeal can be communicated through the same means by which your request was submitted.

Exercising your California and Colorado Privacy Rights

If you are a resident of California or Colorado and wish to exercise any of the rights described above, please submit a request to us by one of the following methods:

You may appoint an agent to exercise your rights on your behalf, and you may exercise rights on behalf of your minor child, if we have collected their information.

We will only process your request if you are a resident of California or Colorado. If you make a request, we will take steps to verify your request, including that you are a California or Colorado resident, that you are the person making the request, or that the person making the request on your behalf has your legal authority to make the request. Additionally, in order to verify your request, the request must include sufficient information that allows us to reasonably verify that you are the person the personal information we have collected relates to (or you are authorized to act on that person’s behalf), and you must describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it. We will only use the information you or your agent provides when making a request to respond to your request.

We will endeavor to respond to all requests within 45 days. If we cannot respond within this time period, we will inform you of the reason and process your request within 90 total days. We do not charge a fee to process or respond to your request unless it is excessive, repetitive or manifestly unfounded. If we determine that the request warrants a fee, we will tell you how we arrived at that decision and provide you with a cost estimate before fulfilling your request. You may only make a request to exercise your right to access and right to portability twice within a 12-month period.

Notice of Financial Incentive (California Residents)

Yoga Under the Palms occasionally administers giveaways, surveys, and sweepstakes, and offers a discount to individuals who sign up to receive marketing emails (together, the “Programs”). From time to time, we may offer free products, coupons or other price reductions for our products and services in exchange for your voluntary participation in these Programs. We offer these Programs to enhance our relationship with you so that you can enjoy more of our products and services at a lower price. When you participate in any of these Programs, you agree to allow Yoga Under the Palms and its Program-related service providers to: (i) collect personal information and information about your purchases and interactions with Yoga Under the Palms; (ii) use the information as outlined in this section and in our Privacy Notice; and (iii) share the information with our service providers, affiliates, and third parties as identified and described in Yoga Under the Palms’s Privacy Notice. The categories of personal information we may collect through these Programs are described in our Privacy Notice. We utilize the information we collect through the Programs and from your commercial relationship with us to gain insights and feedback about your use and purchase of Yoga Under the Palms products and services in order to improve our products and services, and market additional products and services to you. Under California law, rewards offered through the Programs may be considered a financial incentive provided in exchange for the collection, use, and retention of personal information. While Yoga Under the Palms does not assign a monetary value to the data we collect through the Programs, based on our reasonable estimate, the value we receive from your personal information by participating in the Programs is reasonably equal to the value of the product, discount or financial incentive we provide to participants in the Programs.
